By creating an account or using the Kachka mobile application ("App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
Kachka is a fitness coaching marketplace that connects personal training coaches with clients. Coaches can publish their availability and specialties, and clients can discover nearby coaches and book training sessions. Kachka facilitates the connection between coaches and clients but is not itself a provider of fitness or training services.
You must create an account using a valid email address and password to use the App. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep your profile information up to date.
You agree not to: (a) use the App for any unlawful purpose; (b) impersonate any person or entity; (c) harass, abuse, or threaten other users; (d) post false, misleading, or fraudulent content; (e) interfere with the proper functioning of the App; or (f) attempt to gain unauthorized access to the App or its systems.
Coaches set their own schedules, session durations, and availability through the App. Clients may book available sessions with coaches. All payments for sessions are arranged and handled directly between coaches and clients outside the App. Kachka does not process payments, set pricing, or take commissions. Cancellation policies are determined by individual coaches.
You retain ownership of any content you submit to the App, including profile information and photos. By submitting content, you grant Kachka a non-exclusive, royalty-free license to use, display, and distribute such content within the App for the purpose of providing the service.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Kachka does not guarantee the quality, safety, or legality of services offered by coaches. Kachka is not liable for any injuries, damages, or losses arising from training sessions arranged through the App. To the maximum extent permitted by law, Kachka shall not be liable for any indirect, incidental, special, or consequential damages.
Kachka does not verify the qualifications, certifications, or credentials of coaches on the platform. Users are responsible for evaluating the suitability of any coach before booking sessions. You should consult a medical professional before beginning any new exercise program.
Kachka reserves the right to suspend or terminate your account at any time, with or without cause and with or without notice. You may delete your account at any time through the App. Upon termination, your right to use the App ceases immediately.
Kachka may update these Terms of Service from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
